Hello,

We are a small game-dev indie team of two. We are very interested in using ActorCore animations for our game projects, but we are really confused with licensing terms.
So, what we have:
* we are a team of two individuals, we do not have any legal entity => so we can buy animations only as individuals.
* we are interested to use animations with different game engines. So far our primary engine is Unreal, but we are very interested to try the Godot and probably some other game engines => so we want to buy once and use purchased assets across different game engines / game projects.
* we are interested to sell some of our project => so we are talking about commercial projects
* we are interested ONLY in animations => we will use only our own character meshes and we are not going to use any other Reallusion products (software, meshes, etc)
* we are interested in modification of purchased animations => so we need rights to modify the purchased animations according to project's needs

The question : can we buy animations as individuals and use them as described above, or this will be against of some license terms ?

Thanks in advance!

Hello,

Hi...

Apologies for late approval of your post. Unfortunately our system sometimes fails to notify when a new post is submitted. Thankfully it is only your first two posts that need approving. From then on posts will appear immediately.

* we are a team of two individuals, we do not have any legal entity => so we can buy animations only as individuals.

If you have two individual accounts then you both need to purchase the content unless you buy two seats and use the same account. One person can't purchase the content and share with the other unless in a Workgroup which starts with a minimum of three seats. You can find out more HERE.

* we are interested to use animations with different game engines. So far our primary engine is Unreal, but we are very interested to try the Godot and probably some other game engines => so we want to buy once and use purchased assets across different game engines / game projects.

That's not a problem. Once purchased you can use the content in any game engine or software you wish.

* we are interested to sell some of our project => so we are talking about commercial projects

I'm not entirely sure what you mean by sell your projects. You can't resell the content itself but you can sell videos or games that use the content.

* we are interested ONLY in animations => we will use only our own character meshes and we are not going to use any other Reallusion products (software, meshes, etc)

Motions are covered by the Standard License so that is all you need.

* we are interested in modification of purchased animations => so we need rights to modify the purchased animations according to project's needs

You are free to modify any purchased motions and use the modified motions in your games or other applications including VR. However, as mentioned previously, you can't resell the motion itself even if it is an edited version of the original.

Hey Peter,
Thank you very much for your answer! Let me please ask for some additional clarification:

If you have two individual accounts then you both need to purchase the content unless you buy two seats and use the same account. One person can't purchase the content and share with the other unless in a Workgroup which starts with a minimum of three seats. You can find out more HERE.

So, we are going to develop a game. We have a Github repo with the project and we both have access to it and work on this project together. Now, if, for example, we want to use the ActorCore's "Zombie Motions" pack, each of us should buy this pack (so, as a team we have have to buy it twice), right ?

* What about part-time contractors that will be involved in the project ? Should we buy additional copy per each partial-time contractor ?

Like, we are not capable to produce sounds/music and we are not capable to provide good sound design in general, so we are going to hire some composer/sound designer. This person will have access to the project for hired time and there is no way we can provide only "partial" access (without animations). They will never probably directly work with animations, but will have the full access to the project. How should we handle cases like this ?

I'm not entirely sure what you mean by sell your projects. You can't resell the content itself but you can sell videos or games that use the content.

... as mentioned previously, you can't resell the motion itself even if it is an edited version of the original.

We are going to sell only games we developed. No 3rd parties content reselling (in any form, even deeply modified ones).

Thanks in advance!

Hi...

How many copies you would need to purchase depends on if you plan to use Reallusion software in your work pipeline.

So to clarify, you will only need to buy the motions more than once if you all have individual Reallusion Accounts and want to use Reallusion software like Character Creator 4 and/or iClone 8 to edit or customize the content. This is because if one person purchases the content it will only show up in that persons account and won't be available to the others. Of course it won't be a problem if you don't plan to use any Reallusion software like Character Creator 4 or iClone 8 because you can all access the FBX once the purchaser exports it from ActorCore.

So for example one person purchases the motion, then exports it to FBX, where the rest of the team can access the FBX and work on the project in your chosen 3rd party software.

Hey Peter!

Thank you very much for your help! We really appreciate it!

Of course it won't be a problem if you don't plan to use any Reallusion software like Character Creator 4 or iClone 8 because you can all access the FBX once the purchaser exports it from ActorCore.

This is exactly our case, we are not going to use any Reallusion software, we are only interested in FBX for the following use cases:
* Direct import into the engine where it is supported (like UE) - mostly for quick prototyping
* Import into the Blender for adjustments and modifications for further export of modified animation data into the game engines (via FBX or GLTF)
So, the only software to be used (except the game engines) is the Blender.

So for example one person purchases the motion, then exports it to FBX, where the rest of the team can access the FBX and work on the project in your chosen 3rd party software.

This is exactly what we are looking for! But could you please comment on how this aligned with the F.(B) clause of the STANDARD LICENSE (which we are going to use):

...
2.1 STANDARD LICENSE
...
F. Restrictions
...
(B) Redistribution. You may NOT import, upload, reproduce, make available, publish, transmit, distribute, or sublicense the Content to any third party.
...
So, for our real use case, if I will buy ActorCore animation packs (as individual, using my personal ActorCore account), download them as FBX, import into the Blender, modify them, export to GLTF/FBX (modified), add these (re)exported GLTF/FBX to the project repository to use in the game (the project) => will it be the violation of the F.(B) clause of the STANDARD LICENSE due to access of other team member and sub-contractors to this project repository (with reexported (from Blender) FBX/GLTF) ? This is the last question on the matter. If this our use case above is perfectly ok, we are going to buy and use ActorCore animations in our project(s).

Thanks in advance!

The redistribution restrictions just mean that you can’t resell the content or transfer the license to anyone else. If you are not using any Reallusion software in your pipeline, then the method of use you describe will not be a problem and you only need to purchase the motions once.

Problem solved! Thank you very much, Peter! We are going to buy the packs we are interested in.
